3.1 Introduction
As mentioned above, this article is partly based on a legislative proposal applying the insights from the Scandinavian Institute of Maritime Law’s report and Wikborg Rein’s report, to show how Norwegian wage and working conditions may be imposed on board foreign-flagged ships in Norwegian waters and on the Norwegian continental shelf.(1) Arnesen and Furuseth (2020); Arnesen m.fl. (2019); Wikborg Rein (2019). The most important feature of the legislative proposal is a proposed Act relating to Norwegian wage and working conditions in Norwegian waters and on the Norwegian continental shelf. This section presents some of the Act’s solutions for securing national wage and working conditions on board foreign-flagged ships in Norwegian ports and territorial waters, in the Norwegian exclusive economic zone and on the Norwegian continental shelf. Although the future application of the propositions presented here is uncertain, they may serve as an example of how such legislation can be devised.
